By accessing and shopping at cellhelmet.com, you are agreeing to be bound by the following Terms and Conditions and agree that you are responsible for complying with all applicable local laws and regulations.  This is a legally binding contract between you, Kane & McHenry Enterprises, LLC, and cellhelmet.com.  We suggest that you read this entire document before doing business on cellhelmet.com.

1.      CELLHELMET.COM and CELLPIG.COM. cellhelmet.com is the second generation web store of cellpig.com - they are legally interchangeable URL's.  Anywhere that cellpig.com is mentioned must be understood as cellhelmet.com and vice versa.

2.      COPYRIGHTS and TRADEMARKS.  The website cellhelmet.com and all related logos, artwork, and images contained within are the exclusive property of Kane & McHenry Enterprises, LLC.  Expressed consent must be granted by Kane & McHenry Enterprises, LLC before any materials are copied or used from cellhelmet.com.

3.      AFFILIATIONS. cellhelmet.com is exclusively owned and operated by Kane & McHenry Enterprises, LLC.  cellhelmet.com has no affiliation with any brands, providers, or companies mentioned within its pages.  These brands, carriers, names, and logos are used specifically to display accessories and reference the products with which they are to be used.  Products sold on cellhelmet.com are generic, unbranded accessories unless otherwise stated.

4.      SHIPPING. All shipping-time estimates will be quoted at the time of purchase.  cellhelmet.com does not guarantee that shipments will arrive by these quoted dates. Shipping-time quotes are a combination of handling time and estimated delivery times, which are provided by the courier services being used. In the case that a product does not arrive by the estimated delivery date, please contact our customer service team at contact@cellhelmet.com, and we will correct the problem.

5.      SHIPMENTS RETURNED TO SENDER.  Customers will be notified of shipments that are “returned to sender” within 24 hours of receipt.  It is the sole responsibility of the buyer to ensure that the ship-to address is filled out correctly.  cellhelmet.com is not responsible for postage costs on items that must be resent.

7.      LIABILITIES. cellhelmet.com and Kane & McHenry Enterprises, LLC hold no liability for the use of the products sold.  The customer is responsible for any personal or property damages that may be caused by improper use of products purchased from cellhelmet.com and Kane & McHenry Enterprises, LLC.

8.      RETURNS. Return postage expenses are the sole responsibility of the buyer.  cellhelmet.com and Kane & McHenry Enterprises, LLC are not responsible for return postage or packaging.

9.      DEFECTIVE PRODUCTS.  cellhelmet.com and Kane & McHenry Enterprises, LLC assume all responsibility for defective products and will replace them at no expense to the buyer.  All claims must be filed through our customer service team at contact@cellhelmet.com.  We will handle each claim within 24 hours when filed during regular business hours (M–F, 9am–5pm, EST).  Business hours are subject to change without prior warning.

10.      MODIFICATIONS TO THE TERMS AND CONDITIONS OF USE.  cellhelmet.com and Kane & McHenry Enterprises, LLC reserve the right to revise the Terms and Conditions of Use at anytime without prior notice.  By accessing and shopping at cellhelmet.com, you are agreeing to be bound by the current version of these Terms and Conditions of Use.

cellhelmet™ Case Coverage for iPhone/iPod Terms and Conditions - Program Coverage and Repair/Replacement Administration (pertaining only to coverage included with cases manufactured by cellhelmet)

By purchasing and registering a case manufactured by cellhelmet™ you are agreeing to be bound by the following Terms and Conditions and agree that you are responsible for complying with all applicable local laws and regulations. This is a legally binding contract between you, cellhelmet™, Kane and McHenry Enterprises, LLC, cellpig.com and all third parties included in the cellhelmet™ program. We suggest that you read this entire document before purchasing and/or registering your cellhelmet™ product.

1.      REGISTRATION.  Cases manufactured by cellhelmet™ must be registered within 30 days of purchase at http://www.cellhelmet.com/Registration. Failure to register a case manufactured by cellhelmet™ within 30 days of purchase will void all coverage. cellhelmet™ coverage is not to be registered for an already damaged device.

2.      USA and CANADA.  cellhelmet™ coverage is only available for residents of the United States and Canada. The physical product can be purchased outside of the United States and Canada, but will include no coverage.

3.      FILING DAMAGE REPORTS.  All cellhelmet™ accidental damage reports must be filed via 1-888-814-5968 and are not to be directed through the third party retailer where the product was purchased. Each device will be verified, ensuring that it is a properly registered device.

4.      LOST DATA.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC are not responsible for lost data. We recommend that you backup your device prior to shipping in for repair.

5.      PASSCODE REMOVAL.  In order to validate your device and test for functionality, you must remove or disable your passcode, prior to sending in for repair.

6.      HANDLING FEE.  All accidental damage reports associated with coverage that was included with a case manufactured by cellhelmet will be subject to a $50 handling fee, due at the time of report. This handling fee must be paid via credit/debit card prior to repair and must be made payable to Kane and McHenry Enterprises, LLC.

7.      NOT COVERED.  The following are not covered by cellhelmet™: liquid damage, scratches to aluminum/plastic, manufacturer defects, faulty operating systems, prior damages, personalized data such as contact lists, photos, videos and music downloads, customized software such as personal information, screen savers and software applications. cellhelmet™ covers physical damages to the device only. Consult the manufacturer for malfunctioning operating systems.

8.      PREVIOUSLY DAMAGED.  cellhelmet™ coverage does not cover previously damaged devices and it is not to be purchased for the repair/replacement of a damaged device.

9.      BUSINESS DAYS.  Repairs will be handled within 3 business days, but could be subject to delay, due to part shortages and/or product unavailability. If a repair will take longer than 3 business days we will notify you.  Current average repair time is 1 day.

10.      SHIPPING IN.  Fees associated with shipping a device in for repair are the full responsibility of the customer. Please protect your device appropriately with padding to avoid damage during shipment and insure your shipment for the full value of the product. Please keep all labeling on the package discrete. For example, DO NOT write on the packaging "iPhone inside." cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC are not responsible for damages that occur during in-bound shipment or for lost shipments.

11.      SHIPPING OUT.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC will be responsible for charges associated with shipping a device back to the customer. We reserve the right to choose the shipping service provider. The most cost effective shipping method will be selected with a shipping estimate of no longer than 2 days, based on carrier estimates. cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC are not responsible for shipment delays. Two-day shipments are not available for Canadian residents, as shipments must pass through customs.

12.      REPAIR or REPLACEMENT.  Repairs will be administered by cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC and will be performed by cellhelmet and/or a third party repair company. If a device is beyond repair, it will be replaced with a refurbished unit with the same model number or newer. If a replacement should be issued, all additional coverage will become void. Additional coverage can be acquired by purchasing a new cellhelmet™ case or by purchasing a cellhelmet coverage card (different terms apply).

13.      REPLACED DEVICES/PARTS NOT RETURNED.  Damaged devices that are beyond repair will become property of cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC and will not be returned to the customer. All data will be wiped from the device, if possible. If data is unable to be wiped from the device, all data storing parts will be destroyed.  Repaired/replaced parts will also become property of cellhelmet and will not be returned to the customer.

14.      DENIED CLAIMS.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC reserve the right to deny any claim that is assessed as abuse. cellhelmet™ cases are not indestructible and should be handled with care. Reckless behavior may result in a damaged device.

15.      DAMAGE CONSISTENCY.  All known damages must be revealed, when calling in an accidental damage report. Devices that do not physically match the provided damage description will be denied. Damages must be consistent with the provided damage description.

16.      REQUIRED MATERIALS.  When sending a device in for repair, all original parts of the device must be included. Arrivals that are missing original parts will be denied. The cellhelmet case must also be included in the packaging, when coverage was purchased via a case manufactured by cellhelmet.

17.      RETURNS.  cellhelmet™ case returns must be handled via the place of purchase. Return policies are different at each retail operation and should be considered before making a purchase. cellhelmet™ products may not be returned after the registration code has been revealed, regardless of purchase location.

18.      NON-TRANSFERRABLE.  cellhelmet™ coverage is non-transferable and can only be tied to one device and one owner.

19.      COPYRIGHTS and TRADEMARKS.  cellhelmet™ and cellhelmet.com and all related logos, artwork and images contained within are the exclusive property of Kane and McHenry Enterprises, LLC.  Expressed consent must be granted by Kane and McHenry Enterprises, LLC before any materials are copied and/or used from cellhelmet.com or any third party, who is utilizing the materials.

20.      AFFILIATIONS. cellhelmet™ and cellhelmet.com are exclusively owned and operated by Kane and McHenry Enterprises, LLC.  cellhelmet™ and cellpig.com have no affiliation with Apple Inc, iPhone 4, iPhone 4S, iPhone 5 or any carrier or product/service provider mentioned, unless otherwise disclosed. NO ASSOCIATION IS CLAIMED.

21.      GENERAL SHIPPING TERMS. All shipping-time estimates will be quoted at the time of purchase.  cellhelmet.com does not guarantee that shipments will arrive within these quoted times. 25.      RETURNS. Return postage expenses are the sole responsibility of the buyer. All returns must be directed to the retailer at which the product(s) were originally purchased.  cellhelmet™, cellhelmet.com and Kane & McHenry Enterprises, LLC are not responsible for return postage or packaging.

26.      DEFECTIVE PRODUCTS.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC assume all responsibility for defective cellhelmet™ products and will replace them at no expense to the buyer.  All claims must be filed through our customer service team at contact@cellhelmet.com or via 412-610-0692.  We will handle each claim within 24 hours, when filed during regular business hours (M–F, 9am–5pm, EST).  Business hours are subject to change without prior warning.

27.      UNCLAIMED DEVICE. In the event that a device is unclaimed, returned to sender and/or left in the possession of Kane and McHenry Enterprises, LLC/cellhelmet for more than 90 days of receipt, the device will become property of Kane and McHenry Enterprises, LLC/cellhelmet.  Kane and McHenry Enterprises, LLC/cellhelmet will make every reasonable effort to contact the device owner in the event of an unclaimed device via telephone and email.

28.      LIFETIME PARTS AND LABOR WARRANTY. Kane and McHenry Enterprises, LLC/cellhelmet will warrant all replacement parts and related labor charges for the lifetime of the device, as long as the device remains under the ownership of the individual who originally reported the damage.  

29.      MODIFICATIONS TO THE TERMS AND CONDITIONS.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC reserve the right to revise the Terms and Conditions at anytime, without prior notice.  By purchasing and registering a cellhelmet™, you are agreeing to be bound by the current version of these Terms and Conditions.

cellhelmet™ Screen Protectors Terms and Conditions - Program Coverage and Repair Administration

By purchasing and registering a cellhelmet™ product you are agreeing to be bound by the following Terms and Conditions and agree that you are responsible for complying with all applicable local laws and regulations. This is a legally binding contract between you, cellhelmet™, Kane and McHenry Enterprises, LLC, cellhelmet.com and all third parties included in the cellhelmet™ program. We suggest that you read this entire document before purchasing and/or registering your cellhelmet™ product.

1.      REGISTRATION.  cellhelmet™ Screen Protectors must be registered within 30 days of purchase at http://www.cellhelmet.com/Registration. Failure to register cellhelmet™ Screen Protectors within 30 days of purchase will void any and all coverage. The cellhelmet™ Screen Protectors are not to be registered for an already damaged device.

2.      USA and CANADA.  cellhelmet™ scratched glass coverage is only available for residents of the United States and Canada. The physical product can be purchased outside of the United States and Canada, but will include no guarantee of protection.

3.      FILING CLAIMS.  All accidental damage claims must be filed via 1-888-814-5968 and are not to be directed to the third party retailer, where the product was purchased. Each device will be verified upon arrival at our third party repair facility, ensuring that it is the properly registered device. Damage consistency will be verified between the screen protector and the screen, to ensure that a previously damaged device was not sent in for repair.

4.      LOST DATA.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC are not responsible for lost data. We recommend that you backup your device prior to shipping in for repair.

7.      NOT COVERED.  The cellhelmet™ Screen Protector scratched glass coverage only covers scratches in the screen/glass of your device. The following are not covered by cellhelmet™ Screen Protectors: shattered or cracked screens/glass, parts other than the glass/screen, digitizers, malfunctioning screens/digitizers/LCD's, water damage, manufacturer defects, faulty operating systems, personalized data such as contact lists, photos, videos and music downloads, customized software such as personal information, screen savers and software applications. cellhelmet™ Screen Protectors cover physical scratches in the glass/screen of their respective devices only. Consult the manufacturer for malfunctioning operating systems.

10.      SHIPPING OUT.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC will be responsible for charges associated with shipping a device back to the customer. We reserve the right to choose the shipping service provider. The most cost effective shipping method with a "next day" ship date will be selected, based on carrier estimates. cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC are not responsible for shipment delays. "Next day" shipments are not available or guaranteed for Canadian residents or US territories.

11.      GLASS REPLACEMENT.  Repairs will be administered by cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC and performed by a third party repair company. Some devices are constructed with glass/screens that are connected to a digitizer or other materials. If needed to complete the repair, these materials will be included in the glass/screen replacement, at no charge.

12.      DAMAGED GLASS.  Damaged glass that is removed from a device will become property of cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC and will not be returned to the customer.

13.      DENIED CLAIMS.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC reserve the right to deny any claim that is assessed as abuse. All damages will be investigated and screen protector damage must correlate with damage found on the screen/glass. cellhelmet™ Screen Protectors are not indestructible and should be handled with care. Reckless behavior may result in a damaged device. We recommend that you always put a protective case on your device.

14.      SCREEN PROTECTOR UPKEEP.  It is the sole responsibility of the consumer to make sure that the cellhelmet™ Screen Protector is being used in "like new" condition (or better) and to make sure that it is fully covering the glass. Failure to recognize a worn, damaged or misaligned screen protector may result in damage to the glass, which will void all guarantees. Please contact us directly at contact@cellhelmet.com if replacement cellhelmet™ Screen Protectors are needed. Proof of purchase will be required, as well as $2.99 for S&H.

15.      RETURNS.  cellhelmet™ Screen Protector returns must be handled via the place of purchase. Return policies are different at each retail operation and should be considered before purchasing. cellhelmet™ Screen Protectors may not be returned after the registration code has been revealed, regardless of purchase location.

16.      NON-TRANSFERRABLE.  The cellhelmet™ Screen Protector scratched glass coverage is non-transferable and can only be tied to one device and one owner.

17.      COPYRIGHTS and TRADEMARKS.  cellhelmet™ and cellhelmet.com and all related logos, artwork and images contained within are the exclusive property of Kane and McHenry Enterprises, LLC.  Expressed consent must be granted by Kane and McHenry Enterprises, LLC before any materials are copied or used from cellhelmet.com or any third party, who is utilizing the materials.

18.      AFFILIATIONS. cellhelmet™ and cellhelmet.com are exclusively owned and operated by Kane and McHenry Enterprises, LLC.  cellhelmet™ and cellhelmet.com have no affiliation with any brand, company, product, carrier, provider or third party mentioned, unless otherwise disclosed.

19.      GENERAL SHIPPING TERMS. All shipping-time estimates will be quoted at the time of purchase.  cellhelmet.com does not guarantee that shipments will arrive within these quoted times. Shipping-time quotes are a combination of handling time and estimated delivery times, which are provided by the courier services being used. In the case that a product does not arrive by the estimated delivery date, please contact our customer service team at contact@cellhelmet.com or at 1-888-814-5968 and we will acquire and disclose further information.

20.      SHIPMENTS RETURNED TO SENDER.  Customers will be notified of shipments that are “returned to sender” within 24 hours of receipt.  It is the sole responsibility of the buyer to ensure that the ship-to address is filled out correctly.  cellhelmet™ and cellhelmet.com are not responsible for postage costs on items that must be resent.

22.      LIABILITIES. cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC hold no liability for the use of the products sold.  The customer is responsible for any personal or property damages that may be caused by improper use of products purchased from cellhelmet™, cellhelmet.com or Kane and McHenry Enterprises, LLC, other than those accidental damages covered by the cellhelmet™ coverage.

23.      RETURNS. Return postage expenses are the sole responsibility of the buyer. All returns must be directed to the retailer at which the product(s) were originally purchased.  cellhelmet™, cellhelmet.com and Kane & McHenry Enterprises, LLC are not responsible for return postage or packaging.

24.      DEFECTIVE PRODUCTS.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC assume all responsibility for defective cellhelmet™ products and will replace them at no expense to the buyer.  All claims must be filed through our customer service team at contact@cellhelmet.com or via 1-888-814-5968.  We will handle each claim within 24 hours, when filed during regular business hours (M–F, 9am–5pm, EST).  Business hours are subject to change without prior warning.

25.      UNCLAIMED DEVICE. In the event that a device is unclaimed, returned to sender and/or left in the possession of Kane and McHenry Enterprises, LLC/cellhelmet for more than 90 days of receipt, the device will become property of Kane and McHenry Enterprises, LLC/cellhelmet.  Kane and McHenry Enterprises, LLC/cellhelmet will make every reasonable effort to contact the device owner in the event of an unclaimed device via telephone and email.

26.      90-DAY PARTS AND LABOR WARRANTY. Kane and McHenry Enterprises, LLC/cellhelmet will warrant all replacement parts and related labor charges for 90 days post repair receipt.  

27.      MODIFICATIONS TO THE TERMS AND CONDITIONS.  cellhelmet™, cellhelmet.com and Kane and McHenry Enterprises, LLC reserve the right to revise the Terms and Conditions at anytime, without prior notice.  By purchasing and registering a cellhelmet™, you are agreeing to be bound by the current version of these Terms and Conditions.
